НАДЗВИЧАЙНА ПЕТИЦІЯ ЩОДО ПОРУШЕННЯ НОРМ ОСОБИСТОГО ГОЛОСУВАННЯ

НАДЗВИЧАЙНА ПЕТИЦІЯ З ПРИВОДУ ГОЛОСУВАННЯ КАРТКАМИ ВІДСУТНІХ ДЕПУТАТІВ У ВЕРХОВНІЙ РАДІ УКРАЇНИ

Шановні пані та панове!

Ми, громадяни України та інших країн застерігаємо вас від зносин з суб’єктами економічної діяльності,залежними від українського державного регулювання, доки на порядку денному лишається невирішеною серйозна системна проблема в українському державному законодавстві та регулюванні.

Державна проблема, відображена в назві петиції, вже достатньо відома та обговорена, проте досі лишається ‘темною плямою’ для багатьох владних осіб і груп.

Водночас,  через порушення законодавчих норм, в структурі відносин в українському суспільстві реалізується загрозливий для національної безпеки механізм, який унеможливлює значні досягнення для багатьох суб’єктів як в Україні так й поза її межами.

Загальна модель , що пояснює шкоду ґрунтується на теорії систем прийняття рішень:

Для будь якої централізовано-ієрархічної системи прийняття рішень (в якій рівень центральности групи, яка приймає нормотворче рішення, визначає силу норми):

Існує позитивна кореляція між розповсюдженістю ненормативних рішень й найвищим рівнем центральності, на якому відбувається систематичне порушення нормоутворюючої норми.

- де розповсюдженість ненормативних рішень між акторами в системі = підвищення частоти таких рішень, що не відповідають відцентровим регуляторним нормам.

Що це означає для нинішньої ситуації в Україні?

Підтримка української економіки та фінансової системи приречено марна, доки недбалі законодавці при мовчазній згоді Президента, «традиційно» приймають закони фіктивним чином:

- з точки зору кількісного представництва інтересів громадян. Оскільки персональна більшість підміняється уявною - "більшістю карток"

- за визначенням, поданим Конституцією України (ст 84, ч. 3)

Мається на увазі голосування картками відсутніх депутатів – таким чином суб’єктно-опосередкована форма прийняття колективного рішення заміняється об’єктно-опосередкованою.

(Водночас, публікація тексту прийнятого законопроекту, на яку повсякчас посилаються українські суди та органи досудового провадження, очевидно не може бути законодавчим актом, що легітимізує закон для суспільства)

Відповідно, з часом повторювання такої фіктивної процедури, визнання законів перестає бути нормою, і в першу чергу – для владних груп. Інакшими словами, легітимність норм, що встановлюються таким хибним чином а пріорі нижча ніж якби голосування провадилось у нормальному режимі.

Тим не менше, роками, задля власного убезпечення, елітні групи неформально замовчують та тамують факт критичного порушення законодавчої процедури.

Тим часом, заки триває фіктивне прийняття законів, послідовно відбуваються руйнівні процеси:

-         Ріст витрат на безпеку та адміністрування

-         Постійне неконтрольоване збільшення вторинних інструкцій на місцях

-         Ріст кількості логічно нерозв’язуваних судових спорів (розв’язуваних за формальною аналогією, маніпулятивно). Відповідно – й ріст кількості суддів та адвокатів – через ріст потреби у загальній справедливості. Через це, врешті, переповнюються тюрми та ізолятори.

-         Ріст корупції (яку можна визначити загалом, як ігнорування правил в прийнятті рішень)

-         Зниження ділової мотивації та інтересу – як внутрішніх так і зовнішніх економічних суб’єктів

-         Наслідки цілої ситуації пригнічують  різноманітні аспекти цілеспрямованої мотивації усього населення

Ми переконані, що всі відповідальні люди доброї волі мусять зважити на проблеми, перелічені в цій Надзвичайній петиції та призупити всі зносини з українською владою та владними інституціями, доки проблема голосування картками відсутніх депутатів в Україні не буде розв’язана.

Urgent PETITION ON LEGISLATIVE VOTING VIOLATION IN UKRAINE


Respectful Ladies and Gentlemen!

We, citizens of Ukraine and other countries, have to urgently beware you of spending funds and investments into Ukraine’s state-influenced economy, while there is certain system trouble in state legislation & governing.

This problem is currently discovered and articulated, but still is an 'elephant in a room' between power holders.

Object is the root spoiling mechanism for decision-making, that provides high risks for every state-influenced economic subjects in Ukraine and a plenty of such subjects in other countries.

General theoretical model for this case grounds in decision-making theory:

For any centralized/hierarchical (centralized as hierarchical) intelligent desicion system (in which centrality of desicion-making group defines the strengths of provided norms):

There is a positive correlation between the distribution of non-normative decisions and the degree of centrality level, which houses systematic violation in centralized/hierarchical intelligent decision-making systems

- where the distribution of non-normative solutions among actors in the system = increase in frequency of such decisions, that do not agree axifugal regulatory standards.

What it means for the current case:

Support of Ukrainian economy and financial system is doomed to failure in time perspective, as long as unscrupulous legislators, with the tacit consent of the President, "traditionally" accept legislative voting procedure which is fictitious:

- in terms of quantitative representation of citizens' interests

- by norms of the Basic Law -- the Constitution of Ukraine

We mean the so-called 'Knopkodavstvo'/Buttonpushery - in which the subject-mediated mode of action is replaced with the object-mediated mode, by use of absent deputees’ voting cards.

(Publishing of a law in the official journal, to which the present courts appeal, therefore is not a legislative act).

Accordingly, the legitimacy of the entire database of legislation for competing elite groups falls illegitimate (other words legitimacy of norms, provided by this way is a priori lower than if voting was carried out in normal mode).

However, for years, for their own security elite groups have provided informal suppressing of a law adoption discrepancy to a) the procedure, described in the Constitution b) to the proportional representation principle that is embodied in the act of voting - the characteristic of democratic systems in general.

Therefore, consequently while ‘buttonpushery’ take place:

1. security and administration expenses rise;

2. the number of secondary regulations governing interest in the field is eventually growing;

3. the number of logically unsolvable court cases (solved only by analogy or manipulatively) increases (and the number of judges increase according to rise of demand for common justice);

4. corruption is growing (thus it can be defined essentially as ignoring the rules in decision-making);

5. business motivation and investment interest are also reduced - both to the inner and outer business actors

6. consequences of whole situation suppress different aspects of achieving motivations through whole population

We believe, that all the respectful persons of good will should be aware of troubles, described in this urgent petition and force back accounts with Ukraine's state power holders, state-dependent economies and institutions, while the problem of 'Buttonpushery' legislative voting isn't resolved.
